Yes. We regularly travel to local hospitals, medical centers, hospice facilities, and senior living communities throughout East Brunswick, Monroe Township, Helmetta, and neighboring areas to perform urgent signings.
Does a Last Will require witnesses in New Jersey?
Yes. Under New Jersey law, a Will must be signed by two witnesses. To ensure the Will is "Self-Proving" in probate court, both witnesses and the testator must sign a Self-Proving Affidavit, which we then formally notarize.
Can a notary act as a witness to an estate planning document?
A notary cannot serve as both a witness and the officiating notary public on the same document. For wills and POAs that require multiple witnesses, you must supply independent, disinterested witnesses (people not named in the documents) to sign with us.
What form of identification do signers need to provide?
All signers must present a valid, unexpired government-issued photo ID (such as a New Jersey driver's license or passport) to verify identity prior to any notarization taking place.
Is there a difference in mental capacity requirements for notarization?
Yes. A notary must determine that the signer is coherent, fully aware of the document's nature, and signing without coercion. If a signer cannot communicate or understand the transaction due to a medical condition, the notarization cannot legally proceed.
